The Machinery Regulation (EU) 2023/1230 replaces the familiar Machinery Directive and fundamentally changes how manufacturers design, document and place their products on the market. For Dutch and European machine builders this is not an administrative formality but a strategic task: those who start too late risk delayed launches, export barriers and liability. A structured roadmap keeps the transition manageable and helps meet every legal obligation on time.
Why the Machinery Regulation is arriving
The previous directive dates from an era when machines were mostly mechanical and software played a minor role. Since then, machines have become cyber-physical systems: connected, partly autonomous and dependent on software updates. A regulation also applies directly in every member state, without national transposition. That creates uniform rules across the internal market, but it also means manufacturers no longer have national room for interpretation. The heart of the update: explicit attention to digital risks, up-to-date risk assessment and stricter conformity requirements.
Ten steps to demonstrable conformity
A practical approach translates the legal text into concrete actions. A proven roadmap includes, among other things:
- Gap analysis: identify the difference between your current processes and the new requirements.
- Scope definition: which products fall under the regulation and which count as higher-risk machinery?
- Update the risk assessment: explicitly include digital and software-related hazards.
- Adapt design processes: embed safety in the concept phase (safety by design).
- Technical documentation: revise and complete it.
- Conformity assessment: run through it again, including the role of notified bodies.
- CE marking and declaration of conformity: update them.
- Digital documentation: prepare for it, as manuals may be provided digitally.
- Internal knowledge and responsibilities: assign them clearly.
- Involve suppliers so the entire chain moves along.
That last step is often underestimated. Machine builders rely on components and services, from control and switch cabinets to sensors and actuators. Conformity is a shared responsibility across the supply chain.
Cybersecurity and software safety as a core theme
The biggest substantive change lies in the attention to cybersecurity and software safety. Machines must be designed so that malicious manipulation does not compromise safety. A compromised control system must not lead to unsafe conditions, and safety functions must resist unauthorised intervention. For companies working with PLC and control software or robot and machine software, security is no longer an optional extra but part of the legal safety justification. Software updates that change a machine's behaviour may also require a new conformity assessment.
This development aligns with broader European legislation on digital resilience. Anyone further digitising their production with Industrial IoT and connectivity or advanced machine vision and industrial AI will face these requirements. The regulation forces manufacturers to approach digital and physical safety in an integrated way.
What this means for manufacturing
The message for the manufacturing sector is clear: start early. The transition period looks generous, but revising design processes, documentation and conformity procedures takes months, especially when external certification and calibration or additional testing, inspection and NDT are needed. Companies that embrace the regulation early gain an advantage: demonstrably safe, cyber-resilient machines become a selling point towards customers who are themselves regulated.
At the same time there is a risk for smaller special machine builders and suppliers without a dedicated compliance function. For them, a structured roadmap is not a luxury but a necessity. Practice shows that conformity is above all an organisational challenge: assigning responsibilities, building knowledge and involving the supply chain. Those who take it seriously not only meet the law but also build more robust, safer and more marketable products.
